In April 2024, the U.S. Department of Labor (DOL) issued guidance clarifying employers’ responsibilities under federal labor laws when using artificial intelligence (AI) and automated systems in the workplace. This guidance, Field Assistance Bulletin No. 2024-1, focuses on the potential impact of these technologies on areas like wage and hour compliance, leave administration, and employee monitoring.

While AI and automation can streamline various workplace tasks, the DOL emphasizes the need for “responsible human oversight” to ensure compliance with labor laws and prevent systemic violations. This guidance aligns with President Biden’s Executive Order 14110 issued in October 2023, calling for a coordinated approach to responsible AI development and implementation across the federal government. It also coincides with similar guidance issued by the DOL’s Office of Federal Contract Compliance Programs (OFCCP).
